Shell Egg Antitrust Litigation
Serving Clients Nationwide
Eggs are a staple food for households, restaurants, grocery stores, food manufacturers, schools, and other businesses throughout the United States. When competition in this market is distorted, purchasers pay the price.
Cuneo Gilbert Flannery & LaDuca, LLP (CGFL) serves as Co-Lead Counsel and Liaison Counsel for the Commercial Indirect Purchaser Plaintiffs in the Shelled Eggs Antitrust Litigation, a nationwide case alleging that some of the nation’s largest egg producers and industry organizations conspired to fix, raise, maintain, or stabilize prices for conventional shell eggs.
For years, purchasers across the country have experienced significant increases in egg prices. The lawsuit alleges that prices rose to historic levels beginning in 2022, despite production costs that purportedly do not explain the magnitude of those increases. It further alleges that industry participants used pricing benchmarks and information exchanges to artificially raise and sustain prices, causing consumers and businesses nationwide to pay more for one of the most widely purchased food products in the United States.
About the Litigation
The Shelled Eggs Antitrust Litigation is in the United States District Court for the Western District of Wisconsin as a multidistrict litigation (MDL). It consolidates claims brought by purchasers of conventional shell eggs who allege that certain major egg producers and industry organizations engaged in a conspiracy to fix, raise, or maintain egg prices throughout the United States.
The defendants include:
- Cal-Maine Foods, Inc.
- Rose Acre Farms, Inc.
- Versova Holdings, LLC
- Hillandale Farms
- Daybreak Foods, Inc.
- Urner Barry Publications, Inc.
- Egg Clearinghouse, Inc.
- United Egg Producers
The lawsuit alleges that the largest egg producers collectively control a substantial share of U.S. egg production in a highly concentrated market. It further alleges that industry participants exchanged competitively sensitive information and coordinated pricing conduct through industry mechanisms, including benchmark pricing published by Urner Barry and data from Egg Clearinghouse, resulting in artificially inflated prices paid by purchasers nationwide.
CGFL's Leadership Role

The Court has organized the litigation into separate tracks for:

- Consumer Indirect Purchaser Plaintiffs
CGFL serves in a leadership role for the Commercial Indirect Purchasers, representing businesses and other entities that indirectly purchased conventional shell eggs and allege they paid artificially inflated prices as a result of defendants' conduct.
As Co-Lead and Liaison Counsel, CGFL is helping to coordinate discovery, develop evidence, and advance claims on behalf of commercial indirect purchasers across the country.
