About
Jennifer E. Kelly is an attorney at Cuneo Gilbert & LaDuca, LLP, specializing in antitrust, consumer protection, and product liability class actions and complex litigation. With over 20 years of experience in antitrust law, including 14 years representing plaintiffs, she has secured substantial outcomes for individuals, small businesses, and government entities. Ms. Kelly is known for her meticulous approach to litigation, which has been instrumental in resolving high-profile cases.
Ms. Kelly has achieved significant results in her career, including:
- Securing over $400 million in settlements for automobile dealers in In Re: Automotive Parts Antitrust Litigation (E.D. Mich.), involving international price-fixing by auto parts manufacturers.
- Clawing back $26.6 million for the State of Mississippi in the “Mississippi Hustle” cases, addressing kickbacks and fraud within the state’s Department of Corrections.
- Representing hospitals in ongoing litigation against opioid manufacturers and distributors, holding them accountable for their role in the opioid epidemic.
- Advocating for plaintiffs in Fifth Amendment takings cases against the U.S. government, addressing flooding damages caused by the U.S. Army Corps of Engineers’ operations.
- Securing settlements in consumer protection cases against manufacturers of defective building products, including wood, windows, and piping.
Ms. Kelly also holds leadership roles within the legal community. As Vice-Chairperson of the Climate Change Committee for the Committee to Support the Antitrust Laws (COSAL), she co-authored Climate and Antitrust, a forthcoming paper in the Georgetown Environmental Law Review that explores the intersection of antitrust law and environmental protection.
Prior to joining CGL, Ms. Kelly served as a Legislative Assistant to Senator Robert C. Byrd, where she worked on policy initiatives such as reestablishing West Virginia State College’s eligibility for HBCU funding. She also prosecuted and settled over 100 cases of fraudulent use of National Red Cross trademarks as a volunteer attorney.
While in law school, Ms. Kelly worked full time as a paralegal and served as a Student Attorney, successfully arguing fraud cases in Maryland courts. She later gained experience handling antitrust regulatory filings, white-collar crime investigations, and competition counseling at a Washington, D.C., law firm.
Ms. Kelly has been recognized for her accomplishments with numerous awards, including being named a Super Lawyers Rising Star in 2015, 2016, and 2017. She is also listed as a Top 25 Class Action Trial Lawyer by National Trial Lawyers.
