Brendan S. Thompson joined Cuneo Gilbert & LaDuca, LLP as a lawyer in 2008.
Mr. Thompson predominantly practices before federal courts. Throughout his career, he has been a lawyer for consumers.
Cases Mr. Thompson has worked on while at the firm include:
- In Re: Family Dollar Stores, Inc., Pest Infestation Litigation (MDL 3032) (concerning products sold at Family Dollar stores located in various states which allegedly posed health and safety risks).
- Hawes, et al. v. Macy’s West Stores, Inc., No. 17-cv-00754 (S.D. Ohio) (concerning alleged false thread counts (as counted under industry standard ASTM 3775) in sheets and pillowcases).
- Minor, et al. v. Congoleum (D. N.J.) (concerning alleged defective flooring products and refusals to honor warranties which resulted in a nationwide settlement).
- In re: Building Materials Corp. of America (D.S.C.) (concerning alleged defective fiberglass roof shingles which resulted in a nationwide settlement).
- In re Kitec Plumbing Systems (N.D. of Tex.) (concerning alleged defective plastic plumbing systems which resulted in a common fund settlement of $125 million).
In 2017, Mr. Thompson was appointed co-lead counsel in Gold, et al. v. Lumber Liquidators, Inc., 323 F.R.D. 280 (N.D. Cal. 2017). The case concerned bamboo flooring products which Plaintiffs alleged prematurely failed when installed in structures. Plaintiffs successfully defended against motions to dismiss, Daubert motions, a motion for summary judgment, and a transfer of venue motion. The parties exchanged approximately one million pages of discovery and engaged in approximately twenty fact and expert depositions. Plaintiffs certified six state classes and defeated a subsequent Rule 23(f) petition. On October 22, 2020, the Court approved the Parties’ settlement which provided for a $14 million common cash fund and $16 million in vouchers.
Cases Mr. Thompson is currently working on include:
- Mayo, et al. v. Legacy Touch, Inc., No. 3:24-cv-01827 (S.D. Ill.) (alleging that fingerprints of the deceased are taken in violation of BIPA and other statutes and common laws).
- In Re: Change Heathcare, Inc., Customer Data Security Breach Litigation (MDL 3108) (concerning a national data breach which has allegedly harmed individuals, health providers, and hospitals).
Mr. Thompson’s appellate work includes briefing before the Third and Ninth Circuits. See Wright v. Owens Corning, 679 F.3d 101, 109 (3d Cir. 2012).
In 2013, Mr. Thompson assisted in the preparation of an opposition to a petition for certiorari submitted to the U.S. Supreme Court. See Wright v. Owens Corning, 133 S. Ct. 1239 (2013).
In 2009, Mr. Thompson received a diploma from the National Institute for Trial Advocacy (“NITA”).
During his legal studies, Mr. Thompson worked as a Student Intern for Congressman Brian Higgins (NY); as a Student Law Clerk for the Honorable LeRoy F. Millette, Jr. at the Circuit Court for the 31st Judicial Circuit of Virginia; and as a Student Law Clerk at the Commonwealth’s Attorney’s Office for Prince William County, Virginia.
Mr. Thompson has provided lunches to the homeless as a volunteer with Bethesda Cares, donated to Esperanca, participated in Washington Nationals Youth Baseball Academy functions, and assisted the Wood Acres neighborhood with events and activities. He has also spent time mentoring first year students enrolled in the University of Baltimore School of Law’s 1L Mentor Program.
In 2022, Mr. Thompson published an article in the James Joyce Quarterly (Vol. 59) titled “James Henry: The Translator of Ulysses into Irish.”
