Contractors File Amended Complaint in Antitrust Case Alleging Concrete and Cement Additives Price-Fixing

Concrete Pouring

Cuneo Gilbert & LaDuca, LLP, along with co-lead counsel, filed an amended complaint in the United States District Court for the Southern District of New York on behalf of contractors across the country who allege they were harmed by a global price-fixing conspiracy that affected the market for chemical additives and admixtures used in cement, concrete, and mortar in the United States.

The amended complaint, filed on September 26, 2025, alleges that beginning at least as early as March 2021, leading manufacturers of concrete and cement additives—including Sika, Saint-Gobain, Master Builders, and Mapei—entered into a coordinated agreement to fix, raise, and stabilize prices. This alleged conduct forced contractors to pay more for concrete and cement additives and admixtures than they would have if the market had been competitive, driving up their costs. These inflated costs harmed their businesses, reducing profitability and increasing project expenses.

Plaintiffs in the case include general construction contractors, concrete contractors, masonry and cement contractors, outdoor construction contractors, engineering/construction companies, contracting LLCs, and sole proprietorships. The action is brought on behalf of all contractors in the United States and its territories that indirectly purchased chemical additives for cement, chemical admixtures for concrete, and chemical admixtures for mortar.

The case seeks to hold the defendant companies accountable for their alleged anticompetitive conduct and to secure relief for contractors who were overcharged as a result of the alleged scheme.

The case is In Re: Concrete and Cement Additives Antitrust Litigation, 1:24-md-03097-LJL, in the U.S. District Court for the Southern District of New York.
