Cuneo Gilbert & LaDuca, LLP’s lawsuit against National Gypsum and Lowe’s received a favorable ruling this week, which denied the pending motions to dismiss as to strict products liability, negligence and implied warranties (as to Lowe’s). The Honorable Judge David Campbell of the United States District Court for the District of Arizona issued the decision on June 22, 2010 and scheduled a case management conference for August 4, 2010, paving the way for the initiation of discovery. “We are very pleased with the Court’s decision and look forward to aggressively pursuing discovery on behalf of Plaintiff Yee and the proposed class,” said Charles LaDuca. “Plaintiff Yee and his wife have been relegated to sleeping in the backseat of their car because of the defective drywall manufactured by National Gypsum and distributed by Lowe’s” added William Anderson.
