McDonnell Douglas Health Insurance Litigation
This was a class action brought on behalf of thousands of retirees of McDonnell Douglas Corp. (a large aircraft manufacturer since merged with Boeing) under the federal pension protection law known as ERISA. For decades, McDonnell Douglas had promised its employees that they would have company-provided health insurance for life. Despite these explicit promises, when hard economic times hit in the early 1990's, McDonnell Douglas unilaterally sought to cancel its obligation to pay for health insurance for its retirees, many of whom were aged and infirm. After extensive litigation in the district and appellate courts, McDonnell Douglas agreed to a multi-million dollar settlement which restored health insurance for retirees.
