Domestic Drywall Litigation

Yee v. National Gypsum Co., et al., Civil Action No. 3:09-cv-08189-DGC, (D. Ariz.).

 

Our firm, along with co-counsel, filed this national class action against National Gypsum and Lowe's concerning the manufacturing, distribution and sale of defective domestic drywall.  The defective drywall emits, among other things, sulfur compounds that cause significant physical damage to the affected homes by corroding the electrical, plumbing and HVAC systems.  The corrosion created by the defective drywall can create fire hazards, the potential for broken pipes, the failure of air conditioning systems, as well as visible degeneration of fixtures and personal property in the homes. In addition, the defective drywall also poses significant health risks. To date, those living in homes containing the defective drywall have complained of rashes, frequent nosebleeds, insomnia, migraine headaches and numerous respiratory problems. 

 

Motions to dismiss filed by National Gypsum and Lowe's were denied.  Currently Plaintiff's counsel are analyzing discovery materials produced by National Gypsum and preparing for class certification briefing scheduled to occur this spring.
