Indirect Purchaser Rights

Lead Cuneo Gilbert & LaDuca, L.L.P. Attorneys:
Jonathan W. Cuneo
Daniel Cohen

In the case of Gray et al v. Philip Morris et al, we successfully argued that indirect purchasers of products have the right to bring antitrust case under Arizona law. The opinion, argued by Cuneo Gilbert & LaDuca, L.L.P. before the state court of appeals, was upheld in a landmark ruling by the Arizona State Supreme Court under the title of Bunker's Glass Co. v. Pilkington in October, 2003. Because of this ruling, consumers who have been injured by antitrust violations will be able to seek redress in court under Arizona law.
