Attorneys: This putative class action, filed in California state court, arises from the sale of defective Hewlett Packard computers (HP Pavilion). HP manufactured, marketed and sold thousands of HP Pavilion desktop personal computers, warranting that each computer was free from defects in materials and workmanship. Instead, the complaint alleges, many HP Pavilion computers contained a uniform defect that causes the computer to persistently and recurrently freeze, lock and hang. The complaint alleges that the defect stems from the HP Pavilion's motherboard, which contains a video card that has a faulty microprocessor. The defendant was advised by scores of Class members of this defect and its negative impact on performance, but failed to acknowledge or remedy the defect, issue a recall, pay consumers for repairs, or provide notification of the defect on its website or other forms of publication. The suit alleges breach of warranty and other causes of action. |
