Defective Building Products

Product Defects

CertainTeed Defective Roofing Shingles

Update: On September 1, 2010, the Hon. Judge Louis H. Pollak of the U.S. District Court for the Eastern District of Pennsylvania approved a settlement valued between $655 to $741 million on behalf of consumers.

The suit alleges that CertainTeed's organic shingles fail to perform as marketed and that CertainTeed knowingly and intentionally concealed these defects. The suit also alleges that CertainTeed had no intention of providing the services set forth in their warranties for these roofing shingles.

Kitec Defective Plumbing Systems Settlement

Entran II Litigation

One of the largest product defect recoveries in recent history, as sole lead counsel we won a settlement of approximately $345 million in Donato Galanti v. Goodyear Tire & Rubber Company for the defective radiant heating hose known as Entran II. In 2003, the court certified a 44-state class of former and present owners of property at which Entran II was installed and conditionally approved a $236 million settlement with the maker of Entran II, The Goodyear Tire & Rubber Company.

In 2004, the court expanded the settlement to include present and former Entran II property owners throughout the U.S. and Canada and increased the settlement to over $322 million. Beyond these record settlement numbers, we were proud that the court noted the moment of the case and dedication of our team, "the settlement is extraordinarily advantageous given the transaction costs which individual plaintiffs would have pursuing individual claims."

The deadline for present and former property owners to file claims in the Settlement passed on October 19, 2009.
